Supplemental Terms of Service

These Voicemail Drops Supplemental Terms (the “Voicemail Terms”) form part of, and are incorporated into, the Interceptly Terms of Service (the “Master Terms”) and Privacy Policy.

Capitalized terms not defined here have the meanings set out in the Master Terms.

By using Interceptly’s voicemail drop functionality, you agree to these Voicemail Terms in addition to the Master Terms. If there is any conflict, the Master Terms control unless expressly stated otherwise.

1. Scope of Service

Interceptly provides voicemail delivery functionality through its Platform, commonly referred to as voicemail drops or ringless voicemail.

Interceptly does not guarantee:

  • Message delivery

  • Message receipt

  • Absence of phone ringing

  • Absence of missed call notifications

Carrier behavior, voicemail systems, and filtering are outside Interceptly’s control.

Messages may be marked as sent and usage credits deducted when:

  • A carrier reports call progress or ringing, or

  • A carrier answers the call attempt

You acknowledge that charges may apply even if a voicemail is not ultimately received.

2. Compliance Responsibility

You are solely responsible for ensuring that your use of voicemail drops complies with all applicable laws, regulations, and industry rules, including but not limited to:

  • TCPA

  • TSR

  • TRACED Act

  • CAN-SPAM

  • Do Not Call regulations

Interceptly does not provide legal advice and does not represent that use of the Platform ensures compliance.

You must:

  • Verify consent before contacting any recipient

  • Maintain records of consent as required by law

  • Honor all opt-out and Do Not Call requests immediately

  • Regularly audit contact lists for compliance

Interceptly may request proof of consent at any time.

3. No Emergency Calling

All numbers used through Interceptly voicemail services are VOIP-based and do not support emergency calling.

You cannot place emergency calls, including 911, using Interceptly services.

You agree to:

  • Maintain alternative communication services for emergencies

  • Inform all authorized users that emergency calling is not supported

Interceptly is not a substitute for traditional telephone services.

4. Number Usage and Location Transparency

Interceptly may provide access to pooled or assigned VOIP numbers.

You agree not to:

  • Misrepresent the origin or location of a call

  • Mislead recipients regarding area codes or geographic presence

Number availability, continuity, and geographic proximity are not guaranteed.

5. Carrier and Network Limitations

Telecommunications carriers retain full discretion to:

  • Filter messages

  • Throttle traffic

  • Suspend or block campaigns

Interceptly has no control over carrier decisions and is not liable for carrier-imposed limitations, delays, or suspensions.

Delivery speed and throughput are determined by carriers, not Interceptly.

6. Acceptable Use and Prohibited Content

Use of voicemail drops is subject to Interceptly’s Acceptable Use Policy and prohibited content restrictions under the Master Terms.

You may not use voicemail drops for content or industries that are unlawful, misleading, exploitative, or objectionable, including but not limited to:

  • Spam or deceptive messaging

  • Fraud, phishing, or impersonation

  • Debt relief, payday loans, or tax relief schemes

  • Medicare-related solicitations

  • Political attack messaging

  • Car warranty promotions

  • Predatory or exploitative targeting

  • Adult or sexually explicit content

  • Illegal substances or services

Interceptly may, at its discretion, suspend or terminate access for violations.

7. Monitoring, Audits, and Enforcement

Interceptly may monitor voicemail activity to enforce compliance with its Terms and Policies.

You agree to cooperate with reasonable audits, including providing:

  • Consent records

  • Compliance documentation

  • Campaign-related information

Interceptly may investigate suspected violations and cooperate with regulatory or law enforcement authorities as required.

8. Data Use and Privacy

Use of voicemail services is subject to the Interceptly Privacy Policy.

Interceptly acts as a service provider for customer content and does not sell personal data.

Interceptly may collect anonymized usage data for:

  • Platform operation

  • Security

  • Analytics

  • Product improvement

You remain responsible for your own data retention and recordkeeping obligations.

9. Warranties

You represent and warrant that:

  • All voicemail recipients have provided valid, lawful consent

  • Messages are accurate and not misleading

  • Opt-out and Do Not Call requests are honored immediately

  • All applicable laws and industry standards are followed

You are responsible for all activity conducted under your account.

10. Indemnification

You agree to indemnify and hold Interceptly harmless from any claims, losses, fines, penalties, investigations, or expenses arising from:

  • Your voicemail content

  • Your use of voicemail services

  • Failure to obtain or document consent

  • Violations of applicable laws

  • Misrepresentation or misuse of the Platform

11. Updates

These Voicemail Terms may be updated in accordance with the Master Terms.

Continued use of voicemail services after updates take effect constitutes acceptance.
